At 12:40 a.m. on Sunday, June 3rd a suspected drunk driver struck and killed 13-year-old Maximillion Infinity Petrakos on the 60 Freeway in Hacienda Heights. Petrakos was standing with his mother near their disabled Toyota Corolla on the right shoulder of the westbound side of the freeway when 28-year-old Tina Silva swerved and hit them. His mother and 10-year-old brother, who was sitting in the back of the car, sustained injuries ranging from moderate to major and were transported to a hospital. Authorities arrested Silva on suspicion of driving under the influence.
“Drivers who cause accidents resulting in serious or fatal trauma while operating a motor vehicle under the influence of drugs or alcohol may be held liable for expenses associated with the victims’ recovery or their families’ losses,” explained California personal injury lawyer James Ballidis.
Nearly 30 people die every day in the United States in collisions involving an alcohol-impaired driver, which is equivalent to one fatality every 48 minutes, according to the Centers for Disease Control and Prevention. In California, the number of such fatalities has been decreasing in recent years, with the California Office of Traffic Safety recording a 14.4 percent decline from 924 in 2009 to 791 in 2010.
