At about 5:45 a.m. on Thursday, July 12th, a 30-year-old motorcycle rider was fatally injured in a collision with an unlicensed driver in Moreno Valley. While traveling northbound on Pigeon Pass Road in a 1989 Toyota pickup truck, 24-year-old Juan Tzun Lopez turned left onto Charbray Drive in front of the rider, who was heading southbound at the time. The impact threw the motorcyclist to the ground. He was pronounced dead at the scene. Lopez does not possess a driver’s license and is under investigation for vehicular manslaughter.
“Unlicensed drivers account for a significant percentage of the fatal crashes that occur throughout the United States each year,” explained motorcycle injury lawyer James Ballidis. “Under California law, if the crash can be attributed to the negligence of an unlicensed driver, the family of the victim may pursue a wrongful death claim against him or her.”
The AAA Foundation for Traffic Safety analyzed national crash data from 2001 through 2005 and found that 8,030 of the drivers who were involved in 7,679 fatal motor vehicle collisions were definitely or possibly driving with an invalid license or no license. Previous research the Foundation conducted produced similar results, with 13.8 percent of all drivers involved in fatal crashes between 1993 and 1997 having no license, an invalid license, or an unknown license status.
All of us at Allen, Flatt, Ballidis, and Leslie would like to offer our condolences to the family of the motorcycle rider who was fatally injured in the collision with the unlicensed driver.
