Shortly after 9 p.m. on Saturday, February 16, a male passenger in his late 20s was killed in a DUI crash in Palmdale. While traveling at a high rate of speed northbound on the 14 Freeway in a 2007 Toyota, Elder Higueros, of Van Nuys, swerved into the dirt center median near Avenue N. The vehicle then collided with a guardrail, the impact sending it through the air before it landed on its side. The male passenger was fatally ejected from the car. Higueros sustained minor injuries and was arrested on suspicion of driving under the influence.
“When a driver’s negligence causes an accident resulting in the death of a passenger, he or she may be held liable by the family of the victim,” explained California car accident attorney James Ballidis. “In many cases, the family will file a wrongful death claim in order to obtain compensation for their loss.”
Palmdale accounted for 4 of the 346 fatalities and 805 of the 62,881 injuries suffered by motor vehicle occupants in collisions that occurred in Los Angeles County in 2010, according to the California Highway Patrol’s Statewide Integrated Traffic Records System. Eighty-six of the crashes that resulted in injury or death in the city that year involved speeding.
