Auto accident caused by passing car that sideswipes our client.

A motorist attempted to pass our client and misjudged the ability to pass safely.  That driver swerved into our client causing a sideswipe collision.  Our client sustained a broken rib, radicular numbness and tingling into her hand and arm and neck and back pain.  She was treated conservatively but did undergo steriodal injections to address the arm numbness and tingling.  The defendant contended that it was our client that caused the accident, because our client was anxious to pass a slower vehicle ahead of her, and pull into the opposing lane without looking, causing the two vehicles to strike each other.  We prevailed by the testimony of a witness found but not listed on the police report.
