A client contacted us when he was struck while illegally riding on the sidewalk past a car preparing to turn right out of a driveway.  the firm successfully negotiated a settlement of the case on a comparative basis with 50% fault attributed to each.  Soft tissue injuies and knee injury requiring orthoscopic surgery.

California abides by a comparative negligence statute.  When two drivers both commit a wrong, each is responsible for their own negligence that contribuuted to the damages and injury.  In this case, all fault was not reasonably assessed against our client, who although illegally riding on the sidewalk, still was struck by a driver not lookking in his direction when pulling from a driveway.

We have resolved through settlement and verdict over 290 cases in amounts greater than 6 figures.  This year, 2009, seems to be starting off with great results for our clients.  In one case alone, we settled a pedestrian case for $800,000.  The pedestrian was struck by a car with only $50,000 in insurance.  Through the great efforts of our team, we obtained $750,000 of additional settlement from the business on the lot next to where the accident occurred, who was throwing a party for over 500 people without a permit.
