Seriously Injured Plaintiff Receives Multi-Million Dollar Settlement

In a solo car accident, one passenger sustained a serious head injury and the driver sustained significant orthopedic injury. Combined, they received $10,275,000 in settlement after a finding at trial of 30% liability alleged to be caused by improper safety measures by a road construction company during widening of the road.  The defendant road construction company only had $2,000,000 of insurance, and the insurance company refused to settle the claim when a reasonable demand was made.  Subsequently, the jury found in favor for the plaintiffs and against the defendant for partial liability.  Before the damages portion of the trial, we were successful in resolving the case for a $10,275,000 settlement for our client with the insurance company paying the entire settlement even though insurance coverage originally was limited to $2,000,000.   

Insurance companies must act in good faith when representing their insured and make all efforts to settle a claim quickly, fairly, promptly, and in the best interest of their insured.  When they do not, they are subject to the potential liability for the entirety of the verdict or judgment.
