Severely Injured Motorist’s Case Successfully Resolved, Despite Insurer Bad Faith

After a serious collision, motorists often expect their insurance company to mitigate their situation, not aggravate it; after all, insurance policies are purchased to protect drivers at these often trying and traumatic times. Moreover, implicit in every policy is a promise of good faith and fair practices. It is not uncommon, however, for an insurer to place its own interests before that of its insured, or to act in bad faith, explains a California personal injury attorney.

Recently, an elderly motorist driving on a learner’s permit rear-ended our client, the impact causing him to sustain major trauma. Despite the fact that he was not at-fault for the accident, had no past conditions relevant to his injuries, and was accumulating tens of thousands of dollars in medical bills, his insurer refused to provide the $85,000 policy limit it had previously issued him. The insurer claimed our client shared liability for the collision, while at the same time sending letters to the elderly driver absolving our client of any responsibility for the incident. Ultimately, after pursuing two separate lawsuits—one concerning the accident and the other the insurer’s deceptive practices—one of our California personal injury attorneys was able to successfully resolve our client’s case, obtaining for him a total of $210,000.

In many cases, uncovering insurer bad faith requires the time and the resources that are often only available to a legal office. Without the ability to compel the insurer to share the majority of the documents relevant to our client’s accident claim and the close examination of these by experienced attorneys, the company’s egregious acts may never have been exposed.

If you or someone you know suspects insurer bad faith and would like to speak with one of the California personal injury attorney’s in our office, feel free to call 866-981-5596.
