In an unusual claim brought to this office, the family of the deceased, a mother of 4 by a prior marriage, retained us to pursue a wrongful death claims against their recently acquired step-father. He married their mother, a year prior, but caused an accident when he ran into a another car killing her. The investigation demonstrated that the step-father should not have been driving because he had a known unstable seizure disorder and further, there was an unusual and suspect change in the will and trust of the decedent.
The claim was successfully resolved against the step-father with rights to the estate restored to the family, and a cash settlement. It was also thought that the Doctors shared some responsibility for this accident, since the step-father had seen doctors for seizure disorder for several years. Records supported the conclusion that the doctors were negligent in allowing a license to be renewed. After trial, the jury concluded the doctors were not liable because the step-father had concealed the instability of his condition. We felt ifferently, but the family thought this was an important case to prosecute because of the volume of injury accident that are preventable by early physician intervention.
