Truck accident casuses woman to lose her pregnancy!

Our client contacted us about two months after a horrific truck accident.  While on the 710 freeway, she was trapped by a truck merging into her lane.  He vehicle got caught under the truck trailer and was thrashed about, until it was brought to a stop.  Our client was 2 months pregnant and two months after the accident, lost the pregnancy.  The defense contended that the preganancy was lost from natural miscarriage, pointing out through expert testimony that  statistically more than 50% of all preganancies are lost by natural misscarriage.  The defense also noted that if the accident was the casue of loss, it would have occurred sooner.  We were successful in showing through expert testimony, that she was expected to deliver a viable healthy child but this accident caused an abruption of the placenta that was undetectable but later caused the loss.  There was no reason to believe she would have lost the pregnancy.  The trial judge found our expert correct and awarded for our client.

Awarded: $375,000.
