The collision occurred near the intersection of Loma Vista Road and Victoria Avenue when another vehicle broadsided the car in which the woman was a front-seat passenger. After being extricated from the wreckage, she was transported to a local hospital, as was a man who suffered minor injuries in the accident. 

“When vehicle occupants suffer trauma in a collision, the at-fault driver may be held liable for the expense of their medical treatment and recovery,” explained California personal injury lawyer James Ballidis.

The city of Ventura accounted for 2 of the 50 fatalities and 471 of the 4,259 injuries suffered by motor vehicle occupants in collisions throughout the county in 2009, according to the California Highway Patrol’s Statewide Integrated Traffic Records System. Comparing 56 cities with populations ranging in size from 100,001 to 250,000, the California Office of Traffic Safety ranked Ventura 33^rd for fatal and injury crashes in a rating system in which 1^st place is the worst a city can receive.

After attempts to subdue one of the pit bulls with a Taser failed, officers shot and killed the dog; animal control officers found the other dog nearby and impounded it. 

“Under California law, the owner of a dog may be held liable if the animal causes harm to others,” explained California personal injury lawyer James Ballidis.

California Civil Code Section 3342 indicates that when a dog bites a person who is in a public place or lawfully in a private one, the owner of the dog may be held liable for the victim’s damages, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness. Every year in the United States, dogs bite more than 4.7 million people, according to the Centers for Disease Control and Prevention.

Stokes, the driver of the Cadillac, was transported to a local hospital and then airlifted to Loma Linda University Medical Center to receive treatment for her injuries. Witnesses, or anyone with information about this accident, are asked to contact Deputies Ryan Smith or Kevin McCurdy at 760-947-1500.

Instead of remaining at the scene to administer aid, the driver, who is described as a heavy-set Latino man with short hair and a goatee, drove over the pedestrians and fled. Paramedics transported them to the hospital, where Arriola died and his daughter remains in critical condition in a coma. Authorities are searching for the driver, whose vehicle is missing the front Cadillac emblem and should be damaged on the right front end. Witnesses, or anyone with information, have been asked to contact the CHP at 323-259-2010.

Each year, the California Office of Traffic Safety compares the rates of traffic fatalities and injuries in cities with populations of a similar size. Cities with numerous collisions receive high rankings from the agency, with 1^st place being the worst. Year after year, several Orange County cities have placed among the worst in the state for fatal and injury crashes involving drunk driving. 

“Despite significant investment in measures to address the problem, the consequences of drinking and driving continue to devastate families in the area,” said an auto accident attorney in Orange County. 

In 2010, Newport Beach and Orange placed higher than all the cities in their population groupings for fatal and injury alcohol-involved crashes: Orange ranked 1^st out of 53 cities with populations ranging from 100,001 to 250,000; Newport Beach ranked 1^st out of 103 cities with populations of 50,001 to 100,000. Other areas that scored poorly include Huntington Beach and Costa Mesa, placing 5^th and 4^th out of 53 cities, respectively; and Santa Ana, which ranked 3^rd out of 13 cities with populations of more than 250,000. 

The efforts of state officials and law enforcement in the county to remedy the problem have effected change in recent years. Grants from the Office of Traffic Safety have enabled police and California Highway Patrol officers to conduct DUI checkpoints and saturation patrols on weekend nights and holidays—peak times for impaired driving. Such measures have contributed to a continuous decline in fatal, alcohol-related collisions from 2006 to 2010. Hopefully, this trend will continue.

The accident occurred in the underground parking structure of an apartment building on Georgia Street near University Avenue. While backing into a parking space, the man accidently applied the gas instead of the brake and hit the woman, who was in the midst of accessing her storage unit. She sustained moderate injuries. Police arrested the driver on suspicion of felony driving under the influence.

Nationwide, the number of pedestrians killed or injured in traffic accidents increased from 2009 to 2010, a contrast to the trend toward declining fatality rates among passenger vehicle occupants, according to the National Highway Traffic Safety Administration. During this period of time, pedestrian deaths increased by 4.2 percent and injuries by 19 percent throughout the country. California recorded a greater increase in fatalities: 5.4 percent.

While traveling east on Highway 119, the driver of the pickup, 34-year-old Jason Porschakin, veered onto the shoulder of the westbound lane and struck a 2009 semi stopped on Tupman Road. Pinedo was pronounced dead at the scene. Porschakin sustained major trauma and was taken to a local hospital, as was the semi driver, who suffered minor injuries.

“When a passenger suffers serious or fatal injury in a car or truck accident, the driver responsible for the crash may be held liable for expenses incurred by the victim during recovery or by his or her family due to their loss,” explained California truck accident lawyer James Ballidis. 

Throughout Kern County, 136 motor vehicle occupants were killed and 4,313 were injured in traffic accidents in 2009, according to the California Highway Patrol’s Statewide Integrated Traffic Records System. That year, 19 of these fatalities and 158 of the injuries were sustained in collisions involving semi and other large trucks.

Penhall, the son of former motorcycle racing champion and film star Bruce Penhall, was working on a project for Caltrans when a Toyota Rav4 veered into construction barricades and hit him. Authorities arrested the driver of the Toyota, 37-year-old Tatsuhiko Sakamoto, on suspicion of driving under the influence, driving without a license, and vehicular manslaughter. 

“Although the incidence of alcohol-related traffic fatalities has declined in recent years, every life lost exacts a tremendous toll on the family of the victim,” said California personal injury lawyer James Ballidis. 

Los Angeles County accounted for 204 of the 1,146 traffic fatalities and 4,672 of the 17,976 injuries that occurred in California in 2009 in which alcohol was a contributing factor, according to the California Highway Patrol’s Statewide Integrated Traffic Records System. Paramedics transported the occupants—two adults and two children—to local hospitals to receive treatment for major trauma. The driver of the other vehicle sustained minor injuries and was also taken to a hospital. Authorities are investigating the accident.
