Interrogatories to ask in wrongful death cases.

A wrongful death claim arises from a claim of death because of the negligence or the conduct of another.  It can be in the form of an automobile accident, a motorcycle accident, a bicycle accident, a truck accident, or any number of other ways in which a life has been taken.

Interrogatories for the particular type of accident should be sent.  You should review the other articles on auto, truck bicycle and motorcycle accident interrogatories, but there are unique questions that should be asked in wrongful death cases.

First, identify the contention of the defendant in defense of the wrongful death.  Do they contend the decedent contributed to the accident?  Does the defense contend that you and your family were not close to the decedent?   Also, questions can be asked about what evidence and information was collected by the defense during the initial investigation of the case, what witnesses are available, and whether the defense has spoken to those witnesses.
