Metrolink agrees to settle all but 10% of the 2005 Glendale crash cases.

Metrolink has agreed to pay 30 million dollars to settle 90% of the wrongful death and personal injury cases arising from the Metrolink crash.  The 22.5 million dollars of the settlement is to be allocated to the heirs in nine wrongful death lawsuits, and fifteen significant injury lawsuits.  The remainder of the settlement will go to the balance of victims with lesser injuries.

What is interesting is that punitive damages have not been awarded or agreed to in the settlement of the case; an issue highly contested in the early stages of the Metrolink allegations of wrongdoing.  Settlement was appropriate given the probable finding and verdict of liability and the seriousness of the injuries to many of the individuals killed or caused physical injury.
